Terms of Service




By submitting your booking you affirm that you have read and accept these terms of service. All references in this Participation Agreement to, “I”, “you” and/or “my” should be taken as referring to the Traveler.

How to Book Your Far Xplorer Trip

             1) Complete the BOOKING FORM.

             2) Await the exciting news of confirmation and secure your spot with a non-refundable $1,000 deposit.

3) Confirm your travel insurance within 21 days and send final payment within 90 days of the trip departure date.

FINAL PAYMENT AND TRIP PRICING

Final payment of the balance due must be made 90 days prior to your trip departure but can be made anytime prior for your convenience. Payments made after the 90 day deadline will be assessed a $150 fee. All pricing is listed in US dollars. Failure to submit the full balance 60 days from the trip date may result in automatic cancellation and forfeiture of any funds paid.

PAY-AS-YOU-GO PLAN

Our payment plan through our online invoice system allows for payments of any amount at any time leading up to the due date.

AIR TICKET PURCHASING

  • Please wait to purchase airfare until the trip minimum is met and confirmed by our office, OR

  • Purchase airfare at the time of booking if the airline offers free cancellation and full refunds.

REFUNDS - Should you decide to cancel your trip

  • Cancelation 120 days or more before trip departure: Full trip payment will be refunded, less your deposit.

  • Cancelation 119-61 days before trip departure: 50% of your trip payment will be refunded.

  • Cancelation 60-0 days before trip departure:  No refund applies.

RESCHEDULED DATES - Should you decide to shift to a different trip

  • 90 days or more prior to departure - 100% of funds paid are applied to a new trip of your choice within 12 months. Minimum participation policies apply. Price differences may apply for other trips.

FORCED MAJEURE CANCELLATIONS & RESCHEDULED DATES

In circumstances where a cancelation is necessary due to any conditions or event beyond our control including, but not limited to, natural events, pandemics, border restrictions, terrorism, or political instability, we will endeavor to transfer your booking to an alternative departure or trip, or we will offer a trip credit to use towards the balance of any new booking.

  • If you elect to reschedule to a different trip within 12 months of cancellation, 100% of funds paid will transfer to the new booking.

Any credits or refunds resulting from cancelation for any reason will be less any non-refundable expenses incurred by us. We are not responsible for any additional expenses you may incur as a result of your booking being canceled or changed including, but not limited to, visas, vaccinations, medical expenses, clothing, equipment, testing, quarantine, travel insurance excess or flights.

  • If you elect not to reschedule, 50% of funds paid will be refunded within 30 days.

REQUIRED TRAVEL INSURANCE

To help defend against loss of any funds paid or for expenses for ground and air travel, we require all guests to secure comprehensive travel insurance. Proof of coverage needs to be submitted within 21 days of your deposit payment. Travel insurance is also required to obtain permits for restricted areas in Nepal.

CANCEL FOR ANY REASON COVERAGE

We recommend securing travel insurance policies with Cancel for Any Reason policy protection as it can guard against more than a base plan policy.

DOCUMENTATION FOR ENTRY TO NEPAL

You can acquire your tourist visas on arrival. We require two additional passport photos to be emailed to our office 90 days prior to departure as well as proof of travel insurance to secure permits necessary to enter national parks in Nepal.

All travelers must have a valid passport which includes 6-months of validity beyond the departure date from Nepal. Your passport must also include one free page for the entry visa stamp.

VISAS AND ENTRY REQUIREMENTS

It is each guest’s own responsibility to know and meet the requirements for entry to Nepal. We recommend that you consult your airline or travel agent, and/or refer to the US State Department for more information.  The Company is not liable for any disruption to trips or any associated costs incurred as a result of you failing to meet the necessary requirements to enter Nepal or pass through any countries on route to Nepal.

COVID-19 REQUIREMENTS FOR ENTRY TO NEPAL AS OF JANUARY 1, 2022

  • There are at present, no stipulations for Covid-19 tests or vaccinations.

HEALTH, SAFETY AND DISCLOSED ABILITIES

Given where we travel, we recommend every guest visit their doctor for a routine physical. It is up to the individual traveler to assess which vaccinations and medical precautions they need to take. Any recommendations we give should not be construed as medical advice.

Guests on Far Xplorer trips must disclose any physical conditions or health concerns that could impair or prevent their safe participation. If at any time our guides or staff feel a guest’s health presents a safety concern, they may be removed from the trip, but we will ensure their safe and comfortable transfer to a hotel in Kathmandu.

MOTORCYCLE RIDER REQUIREMENTS

  • Riders must hold a valid motorcycle license with at least one year of road riding experience.

  • Minimum age 18 to abide by Nepali law and requirements for an International Drivers Permit.

Nepal requires all riders hold a valid International Drivers Permit obtained in their home country

DAMAGE TO MOTORCYCLES

Riders are responsible for damaged motorcycles, and any third party property damaged as a result of an accident. Minor damage up to $200 will be waived as regular wear and tear. Anything beyond that sum will be paid by the rider within 60 days of the trip’s end. We will supply the rider with reciepts for paid repair costs. The good news: Repairing Royal Enfield motorcycles in Nepal is quite inexpensive. We also understand accidents happen and will work within each situation for a happy resolution.

REMOVAL FROM AN ADVENTURE

If at any time during a trip we feel you are unable to continue or deemed unsafe for any reason, we reserve the discretion to remove you from the itinerary and will make arrangements for your safe and comfortable return home. Your safety, and enjoyment, is our first priority. Should you become sick or injured, we will work closely with you and your insurance provider to find a mutually satisfactory resolution. We want you to be safe and comfortable. If at any time you would like to exit the trip itinerary, we will ensure your safe trip home with your secured travel resources (flights).

ALCOHOL CONSUMPTION

We ask no alcohol be consumed by motorbike riders while they have the keys in their possession. Once the keys are turned in for the day, participants may enjoy alcohol in moderation. We strongly advise against consuming alcohol on our trips above 10,000 feet.

CONSENT TO FIRST AID

I provide consent, should the need arise, for my guide to administer first aid to me and any minors traveling with me.  I fully release, indemnify, and hold harmless the Company from any and all actions, and any and all claims, for damages whatsoever which may hereafter arise as a result of any first aid, treatment in response to a set of signs or symptoms and/or the administration of any medication in response to a medical, implied consent or emergency situation that involves myself or any minors traveling with me.

PHOTOGRAPHS AND FILMING

The Company reserves the right to take photographs and/or videos of me during the trip. I agree the Company may use any such photographs and/or videos for business purposes without payment or other consideration.

TRIP RESERVATION AND DETAILS 

My payment of the deposit and/or trip fare and acceptance of this participation agreement constitutes consent to all the provisions of the booking, any associated information provided including the itinerary and the provisions contained in this agreement. The Company provides no warranty, representation or terms and conditions regarding the trip other than those specifically stated in this agreement.  I acknowledge that Far Xplorer is the tour operator and that I have no contract or agreement with any other person or company. 

ITINERARY CHANGES

In some cases we may deviate from the planned itinerary in response to variables outside of our control or to improve the quality of the trip. Guests are encouraged to understand travel in remote destinations requires flexibility.

ASSUMPTION OF RISK

We travel to remote, undeveloped, and at times uncertain parts of the globe. We cannot protect our guests from all risks relative to food health, disease, or injury by any means. Travel can be dangerous and accidents can and do happen. We are not liable for mishaps and accidents to the extent Colorado Law allows. By sending in your deposit and confirming your participation, you agree to the statement below and understand the risks of travel:

             You release, waive, discharge, hold harmless and agree to indemnify Far Xplorer, LLC and its agents, licensees, guides and other representatives from all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services, indirect or punitive damages or otherwise which may arise out of or occur during your travel in connection with the tour or any activities conducted in conjunction there within unless caused by the willful negligence or wrongful act of Far Xplorer, LLC or its employees; and Regardless of the situation or circumstances giving rise to the claim you waive any claims you have, or may at any time have, against Far Xplorer, LLC and its employees and you agree, by accepting the additional inherent dangers and risks associated with the tour, not to make any claim against or seek any compensation from Far Xplorer, LLC and its employees in respect of any personal injury, illness or death suffered by you or damage to or loss of property sustained by you as a result of your participation in the tour.

FORCE MAJEURE AND UNFORESEEN CIRCUMSTANCE

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, infectious disease, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavors to comply with the terms and conditions of any Agreement contained herein.

TERMINATION OF AGREEMENTS AND REFUNDS OF ACTIVE SERVICES

Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway.

GENERAL

The laws of United States govern these terms and conditions. By accessing this website [and using our services/buying our products] you consent to these terms and conditions and to the exclusive jurisdiction of the courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of the Company to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision. These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by duly authorized representatives of the Company.

RESOLUTIONS

Any dispute, claim or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration by Herms & Cullers of Fort Collins, Colorado before [one/three] arbitrator(s). The arbitration shall be administered by Herms & Cullers pursuant to its Comprehensive Arbitration Rules and Procedures [and in accordance with the Expedited Procedures in those Rules]. Judgment on the Award may be entered in any court having jurisdiction. Treble (triple) damages apply for any attempt at a charge-back on credit cards prior to any decision by an arbitrator.

NOTIFICATION OF CHANGES

The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on our web site 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis.

These terms and conditions form part of the Agreement between the Client and ourselves. Your accessing of this website and/or undertaking of a booking or Agreement indicates your understanding, agreement to and acceptance, of the Disclaimer Notice and the full Terms and Conditions contained herein. Your statutory Consumer Rights are unaffected.

By submitting my booking information, deposit, and participating in the trip package, I agree I have read and accept these Terms of Service.
